This is something we encourage all of our friends here at Breakwater Boats and Yacht to adhere to, and hope that all boaters will pay attention to before hitting the water. Lets take a look at the rules for boaters right of way. The rules apply by vessel type and maneuverability. I will break down each below.

The highest priority is given to vessels which have the most difficulty maneuvering. Meaning, the following list contains vessels in order of maneuverability, and from top to bottom who you must yield to in order of importance.

Not under command

A vessel which, for whatever reason, cannot control where it goes. This may have been a hard one to relate to until the gulf oil disaster. From this, a great example exists. The boys at MIT developed automated vessels for oil spill clean up. These vessels are commanded to perform a specific pattern, and are not capable of yielding to boat traffic. So, these are perfect examples of “not under command” vessels.

Restricted in ability to maneuver

A vessel which, because of the tasks it is doing, cannot change direction or speed easily, or at all.

Constrained by draft

A vessel which must stay away from shallower water to avoid running aground.

Vessel which is fishing or trawling (but not trolling)

Trawling is a method of fishing that involves pulling a large fishing net through the water behind one or more boats.

Sailboat under sail or a boat being paddled or rowed

Though as soon as the sailboat uses an engine for power it must follow the same rules as a power boat, whether or not it has sails up.

Power

This means that a power boat must stay clear of a sailboat; power boats and sailboats must stay clear of boats which are fishing or trawling; power boats, sailboats and fishing boats must stay clear of vessels which are constrained by draft; power boats, sailboats, fishing boats and vessels constrained by draft must stay clear of vessels which are restricted in their ability to maneuver; and all of them must stay clear of any vessel which is not under command.

Channel safety

When boating a marked channel, look at it as if driving your car on the street, stay on the right. If crossing a marked channel you must yield to channel traffic before crossing.

These all apply to not only right of way, but how a captain should view overtaking or crossing another vessel. I have seen too many times, boats cruising at full speed on different lines of travel, each coming to a point of intersection with each other, and no one yields or even slows. As they pass within feet of each other, at full speed, with friends and family on board, words and gestures are exchanged. Well, whoever was right, both were wrong. And trying to prove your right of way by means of placing your vessel, family, and life at risk, simply does not make sense.

Diving down to see the statue is a fairly easy task from both scuba divers and snorkelers.
